Terms of service

Version of 28 October 2026.

1. Who provides the service

Pencily (pencily.app) is provided by Wojciech Gałuszewski, Poland — the “operator”. Contact: support@pencily.app.

2. What Pencily is

Pencily is a tool for a service provider — anyone who takes in people or jobs: a booking Notebook in the Android app and in the browser, and a page pencily.app/name where the provider's clients see free times, book and write in the window.

The provider's clients use the page without an account. The agreement to use Pencily is made by the provider, and these terms apply to them. How we treat clients' data is also described in the privacy policy.

3. Account

An account is created with an e-mail address and a password. In the app you can also start without them — such an account has no page for clients until the provider adds an e-mail and a password. The provider is responsible for the password and for what happens on the account.

The provider can close the account at any time — a request sent from the account's address to support@pencily.app is enough. Before that, they can download a copy of all data: the export in the app works on every plan. Once the account is closed, its data is removed from the database, and from backups as they rotate.

The operator may close an account that seriously breaches these terms, after a prior warning by e-mail.

4. Plans and payments

A new account starts with 30 days without limits. After that, unless paid, it moves to the free plan — it is not blocked and the data stays. Accounts created before 28 October 2026 have the period without limits until 1 December 2026.

Free plan: The Notebook, clients, text reminders, summaries and a copy of your data — no limits, forever. The page for clients too: 20 bookings from the page a month and 3 new conversations in the window a day; beyond that the page sends clients to your phone.

No limits: 39 zł for 30 days or 349 zł for a year. Bookings from the page and conversations without limits. One-off payment in the panel (BLIK, Przelewy24, card), charged in Polish złoty (PLN) — your bank converts it at its own rate. No subscription. A payment extends the period without limits by the paid time, counted from the end of the current period. Payments are handled by Stripe; Pencily does not store card or account details.

We refund a payment for a period that has not started yet on request sent from the account's e-mail. A period already started is not refunded, unless Pencily was down through our fault for more than 3 days in a row — then we extend the period by the length of the outage.

5. The provider's content and data

The provider alone is responsible for what they write in the Notebook and show on the page (name, description, price list, news, photos) and for the wording of text messages. Content must not break the law or other people's rights; clearly unlawful content may be hidden by the operator once reported.

Text messages to clients are sent from the provider's phone, from their number and at their cost with their mobile carrier.

The provider is the controller of their clients' data: they are responsible for the legal basis for processing it and for informing clients. The operator processes it on the provider's behalf under section 6.

6. Data processing agreement

By creating an account, the provider (controller) entrusts the operator (processor) with processing the personal data of their clients under Article 28 GDPR. This section is that agreement.

Scope: the client's name and phone number, dates, services and amounts, notes and descriptions entered by the provider, photos attached to jobs, the content of conversations in the window. Data subjects: the provider's clients and people who write through the provider's page.

Purpose and duration: solely providing the Pencily service, for as long as the account exists. The operator processes the data only on the provider's instructions — using the Notebook and the page, and these terms. It does not use the data for its own purposes, does not sell it and does not use it for advertising.

Security: the data sits on an encrypted server disk in the EU, connections are encrypted, backups are made daily. Only the operator, bound by confidentiality, has access to the server.

Sub-processors: OVHcloud — servers and backups in the EU; Google Firebase Cloud Messaging — notifications to the provider's phone (e.g. the client's name or number, the time, the start of a message), Google's servers may be outside the EU; Resend — e-mails with codes to the provider, without their clients' data. The provider agrees to them. We give at least 14 days' notice by e-mail of any change to this list — anyone who does not agree can close the account.

Assistance: the provider corrects and deletes clients' data in the app themselves, and the export hands over everything at once. The operator notifies the provider of a personal data breach without undue delay. On request, it provides the information needed to demonstrate GDPR compliance and allows an audit at an agreed time.

End: once the account is closed, the operator deletes clients' data as described in section 3.

7. Operation and liability

The operator takes care that Pencily works without interruptions but does not guarantee it — technical breaks and failures happen. It is worth downloading the export from time to time.

The operator is not liable for the effects of the provider's content and decisions. Towards businesses, the operator's liability is limited to the amount paid for the last 12 months. These terms do not limit consumer rights.

8. Complaints

We accept complaints at support@pencily.app. Write what they concern and the address of your account — we reply within 14 days.

9. Changes to these terms

We give at least 14 days' notice of a change to these terms by e-mail. Anyone who does not agree can close the account before the change takes effect.

10. Governing law

These terms are governed by Polish law. Disputes are settled by the court having jurisdiction under general rules.
